These General Terms and Conditions of Sale (referred to as “GTCs”) apply, without restriction or reservation, to all sales conducted by the Seller with buyers (“the Clients” or “the Client”) who wish to purchase the products offered for sale (“the Products”) by the Seller on the website https://nailitstickers.com.

The Products offered for sale on the site include:

  • Nail stickers;

The main characteristics of the Products, including specifications, illustrations, and dimensions, are presented on the website https://nailitstickers.com. Clients are required to review this information before placing an order.

The selection and purchase of a Product are the sole responsibility of the Client.

The offers for Products remain valid while stocks last, with specific availability indicated at the time of the order.

These GTCs are accessible to all on the website https://nailitstickers.com and take precedence over any other document.

The Client declares they have read and accepted these GTCs before completing the online order process on the website https://nailitstickers.com.

For any order placed outside France, the shipping address will be handled by our logistics providers, depending on the region. The Client is responsible for ensuring compliance with local customs regulations as the importer of the Products.

For all Products shipped outside the European Union, taxes will be automatically calculated on the invoice.

Customs duties, local taxes, import fees, or state taxes may apply. These are the responsibility of the Client and must be paid directly to the relevant authorities.

ARTICLE 2 – Prices

Prices are displayed by default in US Dollars (USD). However, Clients have the option to select their preferred currency (EUR, CAD, AUD, or GBP) on the website. The final price displayed in the selected currency is calculated based on the current exchange rate, which is updated regularly.

The amount displayed during checkout in the selected currency is the final amount to be paid by the Client. Please note that currency conversions by the Client’s bank or card issuer may result in slight variations in the final charge.

The Client is responsible for any potential banking fees, currency conversion charges, or transaction fees applied by their bank or debit/credit card issuer.

These prices are firm and non-revisable during their period of validity. However, the Seller reserves the right to modify prices at any time outside of these periods.

Prices do not include processing, shipping, or delivery fees, which are billed separately as specified on the website and calculated prior to order confirmation.

The payment requested from the Client corresponds to the total price, including any additional fees.

An invoice will be sent to the Client via email once the order is confirmed.

ARTICLE 3 – Orders

  1. The Client adds the chosen Product(s) to their cart, with the option to delete or modify items before validating their order.
  2. The Client must accept these Terms and Conditions of Sale.
  3. The Client then provides their contact details and selects the delivery method.
  4. Once all information is confirmed, the order is considered final and requires payment by the Client under the specified conditions.

The Product offers remain valid as long as they are visible on the website, subject to available stock.

The sale is only considered valid after full payment. It is the Client’s responsibility to verify the accuracy of their order and promptly report any errors.

The Client is responsible for keeping their information up to date. Updates can be made by logging into their account or by contacting customer service at contact@nailitstickers.com.

To access their personal account and order history, the Client must log in using their email address and the password they set during registration. The Client is responsible for maintaining the confidentiality of their login details.

The Client may request account deletion at any time by using the dedicated option in their personal space or by emailing contact@nailitstickers.com. This request will be processed as soon as possible.

If the Terms and Conditions of Sale are violated, the website https://nailitstickers.com reserves the right to suspend or close the Client’s account after prior notification sent via email.

Account deletion, regardless of the reason, will result in the complete removal of the Client’s personal data.

In the event of force majeure or website malfunction (server downtime, maintenance, or technical issues), access to the account may be temporarily interrupted without the Seller being held liable.

Creating an account implies acceptance of these Terms and Conditions of Sale.

ARTICLE 4 – Payment Terms

The price is paid through secure payment methods, as follows:

  • Payment by credit/debit card;
  • Payment via PayPal.

The price must be paid in full by the Client at the time of placing the order.

Payment data is exchanged securely in encrypted mode using the protocol defined by the approved payment service provider handling the transactions on behalf of the Seller.

Payments made by the Client will only be considered final once the amounts owed have been successfully received by the Seller.

The Seller is not obligated to deliver the Products ordered if the Client has not paid the full price under the conditions stated above.

ARTICLE 5 – Use of Promotional Codes

5.1 – General Terms

Additionally, https://nailitstickers.com reserves the right to refuse or cancel the use of a promotional code if fraudulent activity is suspected.

ARTICLE 6 – Use of Gift Cards

6.1 – Validity of Gift Cards
Gift cards purchased on https://nailitstickers.com are valid for a period of 12 months from the date of purchase. After this period, any remaining balance will be permanently lost and cannot be refunded or compensated.

6.2 – Use of Gift Cards

  • Gift cards can only be used on the website https://nailitstickers.com to purchase available products.
  • They can be used in one or multiple transactions until the balance is fully spent or the card expires.
  • If the total order amount exceeds the value of the gift card, the Client must pay the difference using one of the accepted payment methods on the website.
  • If the total order amount is less than the card’s balance, the remaining balance will remain valid until the card expires. After expiration, any remaining balance will be lost.

6.3 – Terms of Use

  • Gift cards cannot be exchanged for cash, resold, or transferred to a third party.
  • Gift cards cannot be used to purchase other gift cards.

6.4 – Loss or Theft
In case of loss, theft, or fraudulent use of a gift card, the Seller cannot be held responsible, and no replacement or refund will be issued.

6.5 – Claims
For any questions or issues regarding the use of a gift card, the Client can contact customer service at contact@nailitstickers.com or via the contact form on the website.

ARTICLE 7 – Deliveries

Products ordered by the Client will be delivered to the following areas:

  • Metropolitan France, Monaco.

Deliveries are made to the address specified by the Client at the time of their order on the website within an indicative timeframe of:

  • 2 to 3 business days for Metropolitan France and Monaco;
  • After a preparation period of 1 to 2 business days.

Delivery is considered complete when the physical possession or control of the Product is transferred to the Client. Unless otherwise specified or due to the unavailability of one or more Products, all Products in an order will be delivered at the same time.

The Seller agrees to make its best efforts to deliver the Products ordered by the Client within the indicative timeframes mentioned above.

If the Products have not been delivered within 30 days after the indicative delivery date, for reasons other than force majeure or the Client’s fault, the sale may be canceled upon written request by the Client under the conditions provided by applicable law. Any amounts paid by the Client will be refunded no later than 14 days following the termination of the contract, excluding any other compensation or retention.

Deliveries are insured by an independent carrier to the address provided by the Client during the order process and must be accessible to the carrier.

If the Client chooses to arrange delivery through a carrier of their own choice, delivery is deemed completed once the Seller hands over the Products to the selected carrier. The Client acknowledges that it is the carrier’s responsibility to transport the Products safely and assumes all related risks. In such cases, the Seller is released from any liability for delays or damage during transport.

For specific packaging or shipping requests by the Client, these must be agreed upon in writing with the Seller and may incur additional charges as outlined in a quote previously accepted by the Client.

The Client is required to check the condition of the Products upon delivery. Any claims for delivery errors or visible defects must be made within 10 business days of delivery by contacting the Seller at contact@nailitstickers.com and providing proof (e.g., photos). After this period, and in the absence of proper documentation, the Products will be considered compliant and free from visible defects, and no claims will be accepted by the Seller.

The Seller will refund or replace, as soon as possible and at its expense, any Products delivered with non-conformities or visible defects that are duly reported and confirmed by the Seller.

Ownership and risk of loss or damage pass to the Client upon physical possession of the Products. If the Client chooses their own carrier, ownership and risk transfer to the Client upon handover of the goods to the carrier.

ARTICLE 7 Bis – Delivery of Gift Cards

7.1 – Virtual Gift Cards
Gift cards sold on the website https://nailitstickers.com are exclusively virtual products. Therefore, no physical delivery is required.

7.2 – Delivery via Email
The gift card is automatically sent by email to the recipient’s address provided by the buyer at the time of purchase, immediately after the order is validated and full payment is received.

7.3 – Responsibility for Provided Information
It is the buyer’s responsibility to ensure that the recipient’s email address is entered correctly. In case of error, the Seller cannot be held responsible, and no refund or reissue of the gift card will be made.

7.5 – Non-receipt
If the recipient does not receive the email containing the gift card, the buyer is invited to verify the provided email address and contact customer service at contact@nailitstickers.com for assistance.

ARTICLE 8 – Transfer of Ownership

Ownership of the Products transfers from the Seller to the Client upon full payment of the price by the Client, regardless of the delivery date of the Products.

ARTICLE 9 – Right of Withdrawal

The Client has 14 days to exercise their right of withdrawal. According to applicable law, this period starts from the receipt of the first item.

The right of withdrawal may be exercised by using the withdrawal form attached or any other clear, unambiguous declaration expressing the Client’s intention to withdraw. This request must be sent by post to the Seller’s address listed in ARTICLE 1 of these GTCs or via email at contact@nailitstickers.com.

Returns must be made in their original and complete condition (packaging, accessories, instructions, etc.) to allow the items to be resold as new.

Damaged, used, or incomplete Products will not be accepted.

Return shipping costs are the responsibility of the Client.

Upon receipt, reimbursement will be made within 30 days for the returned Products that meet the conditions outlined in this article. The refund will be issued using the original payment method.

Returns made more than 30 days after delivery will not be reimbursed.

ARTICLE 10 – Seller’s Responsibility – Warranties

The Products provided by the Seller are covered by:

  • The legal warranty of conformity for defective, damaged, or non-compliant Products that do not match the order;
  • The legal warranty against hidden defects arising from a material, design, or manufacturing defect affecting the delivered Products and making them unsuitable for use.

Provisions related to these legal warranties are defined by applicable law.

To exercise their rights, the Client must inform the Seller, by email or post, of the non-conformity of the Products or the existence of hidden defects upon discovery.

The Seller will reimburse, replace, or repair Products or parts deemed non-compliant or defective under warranty.

Refunds, replacements, or repairs for Products deemed non-compliant or defective will be made as quickly as possible and no later than 30 days following the Seller’s confirmation of the non-conformity or hidden defect. Refunds may be issued via the Client’s credit card, PayPal account, or SEPA bank transfer, depending on the payment method used.

The Seller’s responsibility cannot be engaged in the following cases:

  • Non-compliance with the laws of the country in which the Products are delivered. It is the Client’s responsibility to verify local laws.
  • Misuse, negligence, or lack of maintenance on the part of the Client.
  • Damage resulting from improper use of the Product or force majeure.
  • Photographs and graphics presented on the website are not contractual and do not engage the responsibility of the Seller.

The Seller’s warranty is, in any event, limited to the replacement or reimbursement of Products that are non-compliant or affected by a defect.

ARTICLE 11 – Personal Data

The Client is informed that the collection of their personal data is necessary for the sale of Products by the Seller and their transmission to third parties for delivery purposes. This personal data is collected solely for the execution of the sales contract.

11.1 – Collection of Personal Data

  • Account Creation: First and last names, postal address, phone number, and email address.
  • Payment: For payment of the Products offered on the website https://nailitstickers.com, financial data related to the Client’s bank account, PayPal account, or credit card is recorded.

Personal data is used by the Seller and its subcontractors to execute the contract and ensure efficient delivery of the Products.

Subcontractor categories include:

  • Transport service providers;

  • Accounting service providers;

11.6 – Security and Confidentiality
The Seller implements organizational, technical, software, and physical measures to ensure the protection of personal data against unauthorized alteration, destruction, or access. However, it is noted that the internet is not a completely secure environment, and the Seller cannot guarantee total security for data transmission or storage.

11.7 – Client and User Rights
In accordance with applicable personal data regulations, Clients and users of the website https://nailitstickers.com have the following rights:

  • To update or delete their personal data;
  • To delete their account;
  • To exercise their right of access to their data;
  • To correct inaccurate data;
  • To request the deletion of their data, in compliance with applicable laws.

ARTICLE 13 – Governing Law – Language

These General Terms and Conditions of Sale (GTCs) are governed by French law.

The Client irrevocably agrees to submit any disputes regarding the validity, interpretation, or execution of these GTCs to the exclusive jurisdiction of French courts.

These GTCs are written in French. In the event they are translated into other languages, the French text will prevail in case of dispute.


ARTICLE 14 – Disputes

For any claims, the Client should contact customer service at the email or postal address provided in ARTICLE 1 of these GTCs.

If no amicable resolution is reached, the Client may use the European Online Dispute Resolution (ODR) platform at https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show.

All disputes that cannot be resolved amicably will be subject to the competent courts under French law.
